Welcome to Rooted Health Co. (“Rooted Health,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, telehealth services, membership services, and related offerings.

By accessing our website or enrolling in services, you agree to these Terms. If you do not agree, please do not use our services.

1. Medical Disclaimer

The content provided on this website, including journal articles, educational materials, and general wellness information, is for informational purposes only.

It is not a substitute for:

  • Professional medical advice

  • Diagnosis

  • Treatment

Medical care is only established once a formal patient-provider relationship is created through appointment scheduling and completed all required consent documentation.

If you are experiencing a medical emergency, call 911 or seek emergency care immediately.

2. Eligibility

You must be at least 18 years old to use our services independently. Minors may receive care with appropriate parent or legal guardian consent.

Telehealth services are only available to patients physically located in states where our providers are licensed (currently Alabama, Florida, and Georgia).

3. Telehealth Services

By scheduling a telehealth visit, you acknowledge and agree:

  • Telehealth involves electronic communication.

  • There are inherent risks, including technology failures or unauthorized access.

  • You are responsible for ensuring a private and secure location during appointments.

  • You understand the limitations of virtual care compared to in-person care.

You may withdraw consent for telehealth services at any time.

4. Membership & Direct Care Services

If you enroll in a membership plan:

  • Membership fees are billed monthly or annually as selected.

  • Membership is not health insurance and does not replace emergency or specialty care

  • Membership does not replace emergency or specialty care.

  • Certain services may incur additional fees

  • Membership terms, cancellation policies, and refund terms are outlined in your membership agreement

Failure to maintain payment may result in suspension or termination of services.

5. Payment Terms

By providing payment information, you authorize us to charge:

  • Visit fees

  • Membership fees

  • Approved additional services

Payments are processed through secure third-party vendors. We do not store full credit card information on our servers.

All fees are due at the time of service unless otherwise agreed in writing.

We reserve the right to suspend services for unpaid balances. 

6. No Insurance Guarantee

Rooted Health Co.  operates on a membership or direct care model.

We do not guarantee insurance reimbursement for services.Patients are responsible for verifying their own insurance benefits independently.

7. Patient Responsibilities

As a patient or user, you agree to:

  • Provide accurate and complete information

  • Update us if your contact or health information changes

  • Follow treatment recommendations

  • Seek emergency care when appropriate

  • Communicate respectfully

We reserve the right to terminate care if there is inappropriate, abusive, or unsafe behavior.

8. Website Use

You agree not to:

  • Use the website for unlawful purposes

  • Attempt to breach website security

  • Interfere with website functionality

  • Reproduce or distribute website content without permission

All website content, branding, and materials are the intellectual property of Rooted Health Co.

While we use reputable vendors, we are not responsible for the independent policies, security,  or practices of third-party services.

10. Limitation of Liability

To the fullest extent permitted by law:

Rooted Health Co. shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from:

  • Use or inability to use the website

  • Delays in care or services interruptions

  • Technology failures or telehealth disruptions

  • Third-party service outages

  • Reliance on information provided on the website

All medical care is provided based on clinical judgement, and outcomes cannot be guaranteed. 

11. Termination of Services

We reserve the right to suspend or terminate services if:

  • These Terms are violated

  • Payments obligations are not met

  • Behavior is unsafe, inappropriate, or abusive

  • Continued care is no longer clinically appropriate

Patients may terminate services at any time according with their Membership Agreement. 

12. Privacy

Your use of our services is also governed by our Privacy Policy and HIPAA Notice of Privacy Practices.

13. Modifications to These Terms

We may update these Terms at any time. Updates will be posted on this page with a revised effective date.

Continued use of services after updates constitutes acceptance of revised Terms.

14. Governing Law

These Terms are governed by the laws of the states in which services are provided, including Alabama, Florida, and Georgia, without regard to conflict of law principles

Dispute Resolution 

In the event of a dispute, you agree to first contact Rooted Health Co. to attempt to resolve the matter informally.

If a resolution cannot be reached, disputes shall be handled in a court of competent jurisdiction in the state where services were rendered, unless otherwise required by law.

Force Majeure

Rooted Health Co. shall not be held liable for delays or failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet failures, or public health emergencies.
